What Lawyer to Choose


Many of us find ourselves in bad situations, irrelevant if we provoked those or not, and we found ourselves in court.
Since most of us are law illiterate, we are forced to engage lawyer in order to defend our rights in front of the court. In most of the cases, it is certain that our case will be failure only because we didn't engage a good representative.
In order to avoid our certain failure, here we will see some useful tips, on how and what to take care of while we engage our defender.


What is lawyer first of all?

Lawyer or legal representative, is a person that we delegate our human basic right on defense in order that him, since it is his profession, and he is fully law literate, represent our defense in front of the court, for our account and in our benefit, as we were defending ourselves.
Lawyer can be only a person that has academic master degree of the University of Law, with passed additional exam for jurisdiction, and at least two years of practice in court.
To hire a lawyer means to sign with him a contract, in which you delegate your right on defense on him.

If at any case you are not satisfied with the work of your hired lawyer, at any moment of trial, you can withdraw your delegation of right on defense and hire a new one.


When i need one?

Depending of the case you are involved in. You don't necessarily have to have a lawyer, which means that in some occasions you can represent yourself in front of the court, if the case is light and easily solved. On the opposite side, if the case you are involved with is a heavy criminal act, the law itself is forcing you to have lawyer to represent you from the reasons of justice, because you by yourself wouldn't stand any chance in duel with public prosecutor.
In all other cases between these two opposite streams, you can have a lawyer and you don't have to. It is up to you to decide (In most cases, it wiser to have it).


Can i afford it?

Do not hesitate to hire a lawyer for your case, just because you think you won't have enough money to finance it. You can easily write a request to the court to give you a representative on the basis of official duty, that will receive his fee from the state budget and not your pocket. The only thing that you need to do is, to attach to that request a paper from tax administration that shows your monthly income and shows also that you are not in possibility to engage a lawyer. In one of its sessions, the court will decide if the lawyer should be given to you or not and you will be notified about that.

You can also suspend him and ask for another one, if he doesn't do his duties well.


What you should know before you hire one.

In case where you decide yourself which lawyer you will employ for your case, you must also take a good care of following matters:

1. What case you got in front of you (civil or criminal).
2. What the specialization of a lawyer that you hire is..
3. How high his ranking is, in lawyer community of your current country.

From these three, the first matter will explain to you what law representative you should search for.
Civil law expert will be good for real estate affairs, contracts and many more, while criminal (penal) law expert will provide you with defense from accusations for some criminal deed that you might be prosecuted for.
Once you are sure about why you are called on court, you will search for one of the two types of lawyers.

What the specialization of a lawyer that you hire is.

Second matter will determine more how effective your defense will be. In simple words, don't expect from lawyer specialized for dui to defend your interests in immigration affairs better than a lawyer who specialized in immigration affairs. Always seek for the narrow specialization.

How high his ranking is, in lawyer community of your current country.

Once that you selected couple of lawyers for your case that you still aren't sure which one to choose, the third matter will give you analysis of their so far work and success. Naturally you should choose according to your abilities to pay the fee and weight of the case, and yet try to choose the one with highest rank that you can afford.
